Of course shooting someone in the face while they are eating a stake and doing nothing else to threaten you is first degree murder. In one of the flashes he said the exact words “I’m him, the butcher” and then Deb immediately shoots him. It is not implausible to say that you were the butcher after he sees Deb enjoying the stake.
